Penalty for unlawfully taking water

127. Penalty for unlawfully taking water





(1) Every person who wrongfully takes or uses water from any reservoir
aqueduct or pipe belonging to or under the control and management of the Board
or from any pipe leading to or from any such reservoir aqueduct or pipe or
from any cistern or other like place belonging to or under the control and
management of the Board or supplied by it with water for the use of any
consumer shall be guilty of an offence and be liable to a penalty of not more
than 10 penalty units.

(2) Every person who illegally diverts or takes water supplying or flowing
into any waterworks water-course or reservoir belonging to or under the
management and control of the Board or who does any unlawful act whereby the
water from any such waterworks water-course or reservoir may be drawn off or
diminished in quantity shall be liable to a penalty of not more than 1 penalty
unit for every day during the whole or any part of which the said supply of
water is diverted or diminished by reason of any act done by or by the
direction of such person.
