Penalty if occupier prevents owner obeying this Act or the orders of the Board

166. Penalty if occupier prevents owner obeying this Act or the orders of
the Board

If the occupier of any premises prevents the owner thereof from carrying into
effect with respect to such premises any of the provisions of this Part or any
order of the Board made in pursuance thereof he shall be liable to a penalty
of not more than 1 penalty unit for every day during the continuance of such
prevention. If the occupier of any premises, when requested by or on behalf of
the Board to state the name and address of the owner of the premises occupied
by him refuses or wilfully omits to disclose or wilfully misstates the same,
the Magistrates' Court, on application made to it, may summon the party to
appear before it at a time and place to be appointed in such summons. If the
party so summoned neglects or refuses to attend at the time and place so
appointed, or if he does not show good cause for such refusal, or if such
wilful omissions or misstatements are proved the court before which such party
is so summoned may impose upon the offender a penalty of not more than 10
penalty units. Every such owner during the continuance of such refusal, and
provided he satisfies the court that he has bona fide endeavoured to comply
with the provisions of this Part, shall be discharged from any penalties to
which he might otherwise have become liable by reason of his default in
executing such works.
