Gasmakers causing water to be fouled

123. Gasmakers causing water to be fouled

Whenever the water supplied by the Board is fouled by the gas of any person
making or supplying gas within the metropolis such person shall for every such
offence be liable to a penalty of not more than 10 penalty units and a further
sum of not more than 1 penalty unit for each day during which the offence
continues after the expiration of twenty-four hours from the service on him of
notice of such offence. For the purpose of ascertaining whether the water is
fouled the Board may dig up the ground and examine the pipes conduits and
works of the person making or supplying gas. But before proceeding to do so
the Board shall give twenty-four hours' notice in writing to the said person
of the time at which the digging and examination is intended to take place,
and it shall give the like notice to the council or person having the control
or management of the street or place where the digging is intended to take
place, and it shall be subject to the like obligation of re-instating the
street and the soil and pavement thereof and to the same penalties for delay
or any nonfeasance or misfeasance therein as provided in this Part with
respect to streets and pavements broken up by it for laying pipes.
