4. Withdrawal of certain functions and powers from Board







(1) Despite anything to the contrary in this or any other Act but subject to
sub-section (2), if the Water Industry Act 1994 or a licence issued under
Division 1 of Part 2 of that Act has, in relation to an area or areas within
the metropolis, given a function or power to a retail licensee and, but for
this section, the Board would also have that function or power in relation to
that area or those areas, the Board does not have that function or power in
relation to that area or those areas and any power or duty of the Board under
this or any other Act to make by-laws, give notices or do any other thing, and
any obligation imposed or authority conferred by or under this or any other
Act on any person in relation to the Board, must be construed accordingly.

(2) This section does not have the effect of removing any function or power of
the Board to receive or dispose of trade waste in an emergency.
