Grant of certificate of competency

15. Grant of certificate of competency



(1) The Authority must grant a certificate of competency to an applicant if
the Authority is satisfied-

   (a)  that the application for the grant of the certificate complies with
        regulation 10; and

   (b)  that the applicant is at least 18 years of age (or is exempted from
        that requirement); and

   (c)  that the applicant is likely to be able to safely and competently
        perform the work to which the certificate relates.

(2) If the Authority refuses to grant an applicant a
certificate of competency, the Authority must give the applicant a written
notice of refusal-

   (a)  that sets out the reasons for the refusal; and

   (b)  that invites the applicant to be heard by the Authority, within a
        specified time of not less than 14 days, in relation to the decision
        to refuse to grant the certificate.
